Assignment of Trademarks Not Effective Unless Assignee Applies to Registrar U/S 42 Within Nine Months: High Court of Calcutta
The Calcutta High Court recently ruled that an assignee is prohibited from using trademarks obtained through assignment if they fail to apply to the Registrar within the maximum prescribed period of 9 months, as mandated by Section 42 of the Trade Marks Act, 1999. The case pertains to 14 pharmaceutical trademarks that were acquired by the petitioners through a public auction conducted under the Insolvency and Bankruptcy Code, 2016. The trademarks were originally owned by Duckbill Drugs Private Limited, which entered into liquidation based on an NCLT order dated April 13, 2021.
Two Factor Authentication will be required for all taxpayers with a revenue in excess of 100Cr. as of July 15, 2023.
Starting July 15, 2023, the National Informatics Centre (NIC) has made 2-factor authentication (2FA) mandatory for taxpayers with an Annual Turnover above Rs. 100 crores. This is to enhance security in the e-Way Bill/e-Invoice System and prevent fraud. Users will need to authenticate with an OTP, which can be received via SMS, the 'Sandes' app, or the 'NIC-GST-Shield' app. Registration for 2FA can be done in the e-Way Bill System, and it applies to both e-Way bills and e-Invoices
